Identity Theft - MSN Attorney Victim of ID Theft

This past week one of our attorneys was the victim of identity theft. His credit card information had been compromised and someone in the Grand Caymans was using his credit card information. Fortunately he found out about it quickly and was able to stop it.

Identity theft is a major concern in today's society. Few people know that there are federal laws targeted at preventing identity theft related to credit card and debit card information. Specifically, the Fair and Accurate Credit Transaction Act ("FACTA") makes it illegal for a business to give you a credit or debit card receipt which either (1) contains more than the last 5 digits of your account number, or (2) contains your card's expiration date. This information can be used to steal your identity and run up charges on your account.

Rick Bearden and I are currently involved in several class action lawsuits against businesses who have disclosed their customers' credit / debit card information. For a recent article discussing identity theft published by the Birmingham News, you may follow this link:

Our firm has filed six class action lawsuits against in Alabama for violation of FACTA.  The defendants include the following merchants: Hooters of Trussville; Hooters of East Birmingham (Hwy 280); Hooters of Huntsville; Surin of Mountain Brook; Surin West; and Surin 280.
